Welcome to TheraBesty. Please read these Terms of Service ("Terms") carefully before using the TheraBesty mobile application (the "App") operated by TheraBesty ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Critical Disclaimer — Not a Medical Service

THERABESTY IS NOT A HEALTHCARE PROVIDER, LICENSED THERAPY SERVICE, OR MEDICAL DEVICE.

The App provides AI-powered mental wellness tools, self-reflection exercises, anonymous peer support, and couples communication exercises for informational and self-improvement purposes only. The App does not provide:

  • Medical diagnoses
  • Clinical therapy or counseling
  • Psychiatric evaluations
  • Crisis intervention services
  • Professional mental health treatment

The AI in TheraBesty is an artificial intelligence language model, not a licensed therapist, psychologist, psychiatrist, or medical professional. AI-generated responses may be inaccurate, incomplete, or inappropriate for your specific situation.

If You Are in Crisis

If you are experiencing suicidal thoughts, self-harm urges, or a mental health emergency:

  • Call emergency services in your country (e.g., 911 in the US, 110 in Jordan)
  • Contact a crisis hotline (e.g., 988 Suicide & Crisis Lifeline in the US)
  • Go to your nearest emergency room

Do not rely on TheraBesty as a substitute for professional mental health care.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to use TheraBesty. By creating an account, you represent and warrant that you are 18 years of age or older. We do not knowingly allow use by persons under 18.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Account Registration

3.1 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

3.2 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts may result in termination of all accounts.

3.3 Authentication Methods

You may create an account using:

  • Email and password
  • Apple Sign-In
  • Google Sign-In

When using third-party sign-in, you authorize us to access the information described in our Privacy Policy from those providers.

4. Description of Services

4.1 AI Therapy Rooms

The App offers AI-powered conversation rooms covering various topics (anxiety, relationships, stress, mindfulness, personal growth, and more). These sessions use artificial intelligence to provide guided conversations, assessments, and reflections. Results and insights are generated by AI and should be treated as educational tools, not clinical assessments.

4.2 Anonymous Peer Support (Stranger Chat)

The App offers anonymous peer-to-peer matching by topic. You are matched with another anonymous user for a time-limited conversation. This feature is for mutual support and conversation only — it is not moderated therapy.

4.3 Couples Therapy Exercises

The App offers structured communication exercises for couples, facilitated by AI. These exercises are designed to improve communication and understanding between partners. They are not a substitute for licensed couples counseling.

4.4 Mood Tracking and Journaling

The App allows you to log daily moods, complete journal exercises, and track emotional patterns over time.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

TheraBesty offers both free and premium features. Free users have daily usage limits on certain features. Premium subscriptions unlock additional features and remove usage limits.

5.2 Subscription Plans

Premium subscriptions are available on a weekly, monthly, or annual basis. Pricing is displayed in the App and may vary by region and platform.

5.3 Billing

All payments are processed through the Apple App Store or Google Play Store. By purchasing a subscription, you agree to the payment terms of the respective platform. TheraBesty does not directly handle your payment card information.

5.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Renewal charges are at the then-current subscription rate.

5.5 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period. No refunds are provided for partial billing periods.

5.6 Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective refund policies. TheraBesty does not process refunds directly.

5.7 Price Changes

We reserve the right to change subscription pricing. Existing subscribers will be notified in advance of any price increase and given the option to cancel before the new price takes effect.

6. Community Guidelines and Acceptable Use

6.1 General Conduct

You agree to use the App in a manner that is respectful, lawful, and consistent with its purpose as a mental wellness tool. You will not use the App to:

  • Harass, bully, threaten, or intimidate other users
  • Share sexually explicit, violent, or otherwise inappropriate content
  • Impersonate another person or entity
  • Share false or misleading information that could harm others
  • Use the App for any illegal purpose
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the App's functionality

6.2 Stranger Chat Rules

When using the anonymous peer support feature, you additionally agree to:

  • Not share personal identifying information, including:
    • Phone numbers
    • Social media accounts or handles (Instagram, Snapchat, WhatsApp, Telegram, TikTok, Facebook, Twitter/X, Discord)
    • Email addresses
    • Real name, location, or workplace
  • Not use the feature for dating, flirting, or romantic purposes
  • Not solicit personal meetings with other users
  • Not send sexually suggestive or explicit messages
  • Not engage in hate speech, discrimination, or abuse
  • Not attempt to circumvent content moderation filters

Messages that violate these rules may be automatically blocked. Repeated violations will result in temporary or permanent account suspension.

6.3 Couples Therapy Rules

When using couples therapy exercises:

  • Both partners must consent to participate
  • Private messages shared during individual turns are confidential and processed only by the AI — they are not visible to your partner during that turn
  • All messages must be respectful and constructive
  • The feature must not be used to manipulate, control, or abuse a partner

6.4 Content Moderation

We employ automated systems and human review to enforce these guidelines. Automated moderation includes:

  • Pattern-based detection of personal information, inappropriate language, and prohibited content
  • AI-powered content safety screening

We reserve the right to review flagged content, investigate reports, and take action including warning, temporary suspension, or permanent ban.

6.5 Reporting

If you encounter behavior that violates these guidelines, you can report the user through the in-app reporting feature. Reports are reviewed by our moderation team, and appropriate action is taken. False or malicious reporting may itself result in account action.

7. Intellectual Property

7.1 Our Content

The App, including its design, text, graphics, logos, icons, AI models, assessment frameworks, room content, and software, is owned by or licensed to TheraBesty and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7.2 Your Content

You retain ownership of the content you create within the App (messages, journal entries, mood logs). By using the App, you grant us a limited, non-exclusive license to process your content as necessary to provide and improve our services, including:

  • Sending your messages to AI service providers for response generation
  • Storing your content to maintain your session history
  • Analyzing anonymized, aggregated data to improve the App

We will not use your individual conversations or personal content for marketing, advertising, or public display.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation.

8. AI-Generated Content

8.1 Nature of AI Responses

AI responses are generated by third-party language models (including Google Gemini and OpenAI). These responses are probabilistic text outputs and should not be interpreted as professional advice, factual assertions, or personalized treatment plans.

8.2 No Guarantee of Accuracy

We do not guarantee that AI-generated content will be accurate, complete, up-to-date, or suitable for any particular purpose. AI models may produce responses that are:

  • Factually incorrect
  • Culturally insensitive
  • Emotionally inappropriate for your situation
  • Repetitive or generic

8.3 Your Responsibility

You are responsible for how you interpret and act on AI-generated content. Always exercise your own judgment and consult qualified professionals for matters affecting your health and well-being.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimers

10.1 "As Is" Service

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 No Medical Warranty

WE DO NOT WARRANT THAT THE APP WILL IMPROVE YOUR MENTAL HEALTH, RESOLVE PSYCHOLOGICAL ISSUES, OR PRODUCE ANY PARTICULAR THERAPEUTIC OUTCOME. THE APP IS NOT CLINICALLY VALIDATED AND SHOULD NOT BE RELIED UPON FOR MEDICAL DECISIONS.

10.3 Service Availability

We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue any feature at any time without notice.

10.4 Third-Party Services

We are not responsible for the availability, accuracy, or conduct of third-party services integrated with the App, including AI providers, payment processors, and push notification services.

11. Limitation of Liability

11.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THERABESTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages arising from your reliance on AI-generated content
  • Any damages arising from interactions with other users (including in stranger chat or couples therapy)
  • Any damages resulting from unauthorized access to your account
  • Any damages exceeding the amount you paid to us in the twelve (12) months preceding the claim

11.2 Mental Health Limitation

YOU ACKNOWLEDGE THAT THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MENTAL HEALTH CARE. THERABESTY SHALL NOT BE LIABLE FOR ANY HARM, DETERIORATION OF MENTAL HEALTH, OR ADVERSE OUTCOMES THAT MAY RESULT FROM YOUR USE OF OR RELIANCE ON THE APP.

11.3 Peer Interaction Limitation

THERABESTY IS NOT RESPONSIBLE FOR THE CONDUCT, STATEMENTS, OR ACTIONS OF OTHER USERS IN STRANGER CHAT OR COUPLES THERAPY. WHILE WE IMPLEMENT CONTENT MODERATION, WE CANNOT GUARANTEE THAT ALL INAPPROPRIATE CONTENT WILL BE DETECTED OR PREVENTED.

12. Indemnification

You agree to indemnify, defend, and hold harmless TheraBesty and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you submit or transmit through the App

13. Account Termination

13.1 By You

You may delete your account at any time through the App settings or by contacting us. Account deletion will permanently remove your personal data in accordance with our Privacy Policy.

13.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or Community Guidelines
  • Repeated reports from other users
  • Abusive behavior toward other users or our moderation team
  • Fraudulent activity
  • Extended period of inactivity

13.3 Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • Active subscriptions are not automatically refunded (you may request a refund through the applicable app store)
  • Your data will be handled in accordance with our Privacy Policy

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at legal@therabesty.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan, without regard to conflict of law principles, except where superseded by mandatory local laws of your jurisdiction.

14.3 Jurisdiction

For users in the United States, any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

For users outside the United States, disputes shall be submitted to the competent courts of Amman, Jordan, unless mandatory local law requires a different forum.

14.4 Exception

Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction for matters related to intellectual property rights or data security.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email at least 15 days before they take effect. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

If you disagree with the updated Terms, you must stop using the App and delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TheraBesty regarding the use of the App and supersede all prior agreements, representations, and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
